These Terms of Service ("Terms") govern your use of the Barkden online store, website, products, and related services (collectively, the "Services").

Barkden is operated by Thryx ("Barkden," "we," "us," or "our").

By accessing or using the Services or purchasing a product from Barkden, you agree to these Terms.

Online Store

Barkden operates an online retail store offering pet-related products.

Some products sold through Barkden are stored, processed, packaged, or shipped by third-party suppliers and fulfillment providers on our behalf.

As a result, product packaging, shipping origin, carrier, and fulfillment location may vary between products and orders.

You may not use our products or Services for any illegal or unauthorized purpose or violate applicable laws through your use of the Services.

Product Information

We make reasonable efforts to ensure that product descriptions, images, specifications, availability, and other product information are accurate.

However, colors and appearance may vary depending on your display, manufacturing variations, product updates, or other factors.

We reserve the right to correct errors, inaccuracies, or omissions and to update product information where reasonably necessary.

Prices and Currency

Prices displayed through Barkden may vary depending on your location, selected market, and applicable currency settings.

Where supported, prices may be displayed and transactions may be processed in your local or selected currency. Currency conversion may be performed automatically using exchange rates and currency conversion mechanisms provided by Shopify, our payment providers, or other applicable service providers.

The currency and final amount presented to you at checkout will apply to your transaction.

Prices may change without notice, but changes will not affect orders that have already been successfully placed, except where correction is permitted or required by applicable law.

Applicable taxes, duties, shipping charges, and other fees may be calculated or displayed separately as appropriate for your location and order.

Orders

Submitting an order does not necessarily guarantee acceptance.

We reserve the right to refuse or cancel an order where reasonably necessary, including in circumstances involving:

Suspected fraud or unauthorized transactions
Payment issues
Product unavailability
Pricing or technical errors
Shipping restrictions
Incorrect or incomplete customer information
Suspected misuse of the Services
Legal or regulatory restrictions

If we cancel an order after payment has been successfully collected, we will refund the applicable amount.

Order Changes and Cancellations

Orders may enter processing shortly after they are submitted.

Because our fulfillment process may be automated, we cannot guarantee that an order can be modified or cancelled after it has been placed.

If you need assistance with an order, contact support@thryx.studio as soon as possible.

If an order can no longer be cancelled, you may need to receive the product and request a return in accordance with our Refund & Return Policy.

Nothing in this section limits any mandatory cancellation or withdrawal right available under applicable consumer law.

Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy.

Delivery estimates are estimates unless expressly stated otherwise.

Delivery may be affected by suppliers, fulfillment providers, carriers, customs authorities, weather, holidays, shipping volume, or other circumstances outside our reasonable control.

Products in the same order may be fulfilled from different locations and may therefore arrive in separate packages or at different times.

Returns and Refunds

Returns, refunds, exchanges, damaged products, and related matters are governed by our Refund & Return Policy.

Customers should contact Barkden at support@thryx.studio before returning a product and follow the return instructions provided.

Do not independently return a product to an address shown on the original package unless instructed to do so by Barkden.

Third-Party Fulfillment and Services

We may use third-party suppliers, fulfillment providers, warehouses, payment providers, shipping carriers, technology providers, and other service providers to operate Barkden and fulfill customer orders.

By purchasing from Barkden, you acknowledge that information reasonably necessary to process and fulfill your transaction may be provided to relevant service providers.

This may include your name, shipping address, contact information, purchased products, and other information necessary to process payment, fulfillment, shipping, delivery, returns, or customer support.

Personal Information

Your submission and use of personal information through the Services is governed by our Privacy Policy.

Our store is powered by Shopify, which may also process personal information in connection with providing ecommerce services to Barkden and our customers.

Accuracy of Information

We reserve the right to correct typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates, product availability, or other information.

Where permitted by applicable law, we may correct such information or cancel affected orders.

Nothing in this section limits mandatory consumer rights.

You may not use the Services:

The Services may contain links to websites or services operated by third parties.

We are not responsible for third-party websites, services, content, privacy practices, security, products, or terms that we do not control.

Disclaimer

To the maximum extent permitted by applicable law, the Services and products are provided subject to the terms, warranties, and consumer protections applicable to the particular transaction.

We do not exclude any guarantee, warranty, condition, right, or remedy that cannot legally be excluded under applicable consumer law.

Limitation of Liability

To the maximum extent permitted by applicable law, Thryx and Barkden will not be liable for indirect, incidental, special, exemplary, or consequential losses resulting from your use of the Services or products purchased through Barkden.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Nothing in these Terms limits mandatory consumer rights or remedies.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Thryx and Barkden from claims, liabilities, damages, and reasonable expenses resulting from your unlawful misuse of the Services, violation of these Terms, or infringement of the rights of another person.

This provision does not apply to the extent prohibited by applicable consumer law.

Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforceable to the maximum extent permitted by applicable law and the unenforceable portion will be considered severed from these Terms.

The remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, Refund & Return Policy, Shipping Policy, and any other policies or operating rules posted through the Services, constitute the agreement between you and Barkden regarding your use of the Services and purchases made through Barkden.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements, or other operational circumstances.

The current version will be published through the Services with an updated "Last updated" date.

Where required by applicable law, additional notice will be provided.

Consumer Rights

Barkden sells products internationally.

Depending on where you live, mandatory consumer protection laws may provide rights concerning purchases, cancellations, withdrawals, warranties, defective products, delivery, returns, refunds, or dispute resolution.

Nothing in these Terms is intended to exclude, restrict, or modify a right or remedy that cannot lawfully be excluded, restricted, or modified.

Subject to any mandatory rights you may have under applicable consumer protection laws, any dispute arising out of or relating to these Terms, the Services, or a purchase from Barkden shall be subject to the jurisdiction of the competent courts in Israel.

If you are a consumer residing in a jurisdiction that provides mandatory consumer rights or permits you to bring proceedings in your place of residence, nothing in these Terms is intended to limit or exclude those rights.
